Looking at the number of 485s pending for ROW EB3 with PD of years 2001 and 2002, I do not quite understand why the dates have not moved. We need to ask this question to someone. It does not make any sense.

and one more thing is if we post our question on one of the related thread, people will have chance to look into that thread and get answers, you know, instead of looking into hundreds of threads on same topic, hundreds of related post in one thread make more sense.

no one is new to the forums, if not here, they might have gone thru all those immigration, murthy forums already.

Let the guy ask. I see a couple of times somebody asking a question, and instead of answering people ask to search at the forum first....
why not just respond if possible or just ignore. I think posting a reply to say to search first is not very usefull at all.

1. Can we use AC21 provision without EAD card ?for 485 AOS -- NO
2. My H1 expires in Jan 2008. Do I need to have EAD card before that ? - If you wish to have one, You can apply EAD to use AC21 after 6 months /renew your H1 and continue working
3. Can we apply for EAD later, after you have filed 485 and AP? yes If so do we need any reciept of 485 application Yes

not a red-dotter - but i do believe we should leave the forums open to talk not just about immigration but also immigrant related issues.

this will help draw more people towards IV who can then contribute to IV core agenda in any way feasible for them.

also will motivate people to hang around IV even once they get their GCs or Citizenship.

hi,

I am confused about whether to suggest 'member of the professions holding an advance degree" or "an alien of exceptional ability" for my NIW petition. What is the criteria to select one over the other? I have a MS/PhD from a US university. Proving to be exceptional is certainly difficult, but then holding an advanced degree may not be enough of a criteria for a successful petition.

I looked at converting to RIR but there seems to be no point in changing. There is no guarantee that an RIR application will be processed before an TR. Also, they are picking up applications in random order and not FIFO. So, I decided against the conversion.

All:

I have a question with regard to legal status:

Case - My current h1, my wife's and son's h4 status will expire within 2 months. My Green Card gets approved today, while my wife and son's stays pending. Since I have the GC, I may not be able to apply for h1 extention.

(a) What will be the status of my wife and son after the 2 month period?
(b) How will I be able to keep my wife and son in a legal status, after the 2 month period

I would appreciate some wisdom here.....
